Petition" is the adjective that qualifies the action by which a person has his right of ownership over real estate recognized in court by relying on the deed of acquisition or the legal situation which confers on him the real right to real estate which is contested: right of (ownership, but also, usufruct, or bare ownership).
• Possessory action:
Possessory actions, which are provided for by articles 1264 and following of the Code of Civil Procedure, aim to protect possession without having regard to the substance of the law, against the disorder which affects it, or which threatens it1. Possessory actions are only open to those who meet the conditions for possession2. The possessor respecting the conditions of possession can therefore act.
But, the peaceful or precarious holder of a thing can also act: it is about the one who exerts the control on a thing, but under the terms of a legal act. But he can never exercise these actions against the person from whom he derives his rights.
